Since Donald Trump was elected U.S. President, our law firm has received countless number of inquiries from foreign investors concerned about potential negative impact of the President’s immigration policies. While it is true that we can expect immigration reforms under the Trump Administration, as an immigration attorney who focuses on helping foreign entrepreneurs, I feel optimistic that any changes will not affect the E-2 Investor Visa program.

Mr. Trump has targeted undocumented immigrants. The President seeks to deport people without legal immigration status in the U.S., and foreign nationals who committed deportable crimes. This means people who reside in the U.S. without lawful visa or immigration status face risk of removal from the United States.

Mr. Trump also seeks to curtail work visas that impact job opportunity for Americans. He has focused attention on reforming the H-1B employment visa. The H-1B visa was intended to allow employers to recruit highly skilled foreign talents in occupations with shortages of qualified U.S. workers. However, some unscrupulous employers have abused the H-1B program by replacing American employees with lower wage foreign nationals. Mr. Trump plans to apply stricter controls of the H-1B visa to ensure proper use for its intended purpose

Foreign investors should rest assured that the E-2 visa program is fully aligned with Mr. Trump’s policy objectives of protecting the American labor market. E-2 investors make substantial contributions to the U.S. economy through financial investments, business development, and direct and indirect creation of employment opportunities for American workers. Mr. Trump was a long time entrepreneur who appreciates the fact that foreign investments help the U.S. economy and create jobs.

As a firm that specializes in E-2 visas, we have experienced high rates of visa approvals since Mr. Trump became President, similar to our success rate under President Obama. There has been no changes to the E-2 visa program so far. Therefore, I strongly believe the E-2 visa has the lowest risk of negative impact from Mr. Trump’s immigration reforms.
